Mr. Parmeshwar Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-01-2019 Heard learned counsels for the petitioner and State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 420 of the IPC and Section 7 of the Essential Commodities Act.

The prosecution case is to the effect that on a secret information, 50 bags of rice were seized from a pickup van when the driver and co-driver of the vehicle in question were arrested, who disclosed that they were carrying the rice from the P.D.S. shop of the petitioner.

It is submitted by learned counsel for the petitioner that without verifying the stock of the petitioner, who is a PDS dealer, the accusation has been levelled against him. It is further submitted that there is no complain either by the supply authorities with regard to non-maintaining the stock

Patna High Court Cr.Misc. No.4711 of 2019(2) dt.29-01-2019 2/2 register by the petitioner nor by any consumer with regard to non-supply of grains. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the name of the petitioner sprang up on the confession of the driver of the alleged vehicle. Considering the suspicious nature of accusation and the petitioner being a lady, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Darbhanga in connection with Keoti P.S. Case No. 131 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
