JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioners are in custody since 20.12.2014 in Tr.No.27/15/1/15 arising out of Gopalganj Town P.S.Case No.574/2014 for the offences under Sections20,21,22 of the N.D.P.S. Act.

Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that on 19.12.2014 as soon as the informant on a secret information along with police party arrived at the place of occurrence 3-4 persons started fleeing away and on chase three persons were caught and they disclosed their names. On search, 5 grams smack kept in small packet was recovered from the possession of accused Hari Patel whereas 3

Patna High Court Cr.Misc. No.25951 of 2015 (2) dt.23-07-2015 2/2 gms smack kept in tiny packet from the possession of each of the petitioners.

It has been submitted on behalf of the petitioners that they are in custody since 20.12.2014 and the charge sheets have been submitted in the case.It is further submitted that 3 grams smack is said to have been recovered from the possession of the petitioners which amount comes within purview of small quantity. It is further submitted that other co- accused has already been granted bail vide Cr.Misc. No.10349/15.

On behalf of the State it has been submitted that the petitioners have been named in the F.I.R..

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Sessions Judge, Gopalganj, in Gopalganj (Town) P.S. Case No.574/14.
