Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has preferred this application for grant of regular bail in connection with Beur P. S. Case No. 90 of 2022 and Special Case No. 1235 of 2022) dated 25.02.2022 registered for the offences punishable under Sections 30 (a), 36, 41 and 44 of the Bihar Prohibition and Excise Act. As per the prosecution case, total 962.43 litres of illicit liquor was recovered from ground floor of the house of

Patna High Court CR. MISC. No.9096 of 2023(2) dt.29-04-2023 2/3 the co-accused Madhuri Sinha. It is further alleged that the petitioner used to help in the illegal business of wine of the coaccused Madhuri Sinha. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No such occurrence as alleged has ever taken place. Nothing has been recovered from the conscious possession of the petitioner. Learned counsel has further submitted that the coaccused person has already been granted anticipatory bail by Co-ordinate Bench of this Court vide order dated 20.05.2022 passed in Cr. Misc. No. 24473 of 2022. The petitioner is found accused in two other criminal cases which relates to the Excise Act as stated in para 3 of the bail petition. The petitioner is in custody since 15.12.2022.

Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court Concerned, Patna in connection with Beur P. S. Case No. 90 of

Patna High Court CR. MISC. No.9096 of 2023(2) dt.29-04-2023 3/3 2022 and Special Case No. 1235 of 2022).

The application stands allowed.
