The petitioner is apprehending his arrest in connection with Gaurichak P.S.Case No.99 of 2017 , registered for offences punishable under Sections 406, 420, 34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.
Allegation against the petitioner and other accused persons is that they negotiated the marriage of the petitioner with the daughter of the complainant/informant and took Rs.15,000/- but later on he refused to marry . Submission of the learned counsel for the petitioner is that the marriage was negotiated by the parents and he has no role in that and the other accused persons including his parents have been granted privilege of anticipatory bail, vide
Patna High Court CR. MISC. No.13136 of 2019(4) dt.30-04-2019 2/2 order dated 5.4.2018 passed in Cr. Misc. No.17715 of 2018. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Patna City in connection with Gaurichak P.S.Case no.99 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid direction, this application is allowed.
