The petitioner seeks bail in connection with Bypass P.S. Case No. 443 of 2021 instituted for the offences under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.11.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Learned counsel for the petitioner submits that the allegation is of recovery of 200 litres of liquor from gunny bag. Learned counsel for the petitioner submits that the petitioner was a mere passerby and came to be implicated when the search was made.

Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.6946 of 2022(2) dt.08-03-2022 2/2 bail of the petitioner.

Considering the fact that the petitioner is in custody and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Spl. Judge, Excise, Patna in connection with Bypass P.S. Case No. 443 of 2021.
