The grievance of the petitioner in the present case is against discrimination in the matter of payment of salary. Learned counsel for the petitioner submits that similarly circumstanced other teachers are getting higher pay scale and the petitioner is being paid less pay scale. He submits that the petitioner has filed representation, Annexure-4 series before the District Programme Officer, Establishment, Nalnda as well as the Director, Secondary Education.

Patna High Court CWJC No.8137 of 2017(3) dt.12-04-2018 2/2 In view of the fact that the petitioner has approached the respondent-Director, Secondary Education indicating therein that similarly circumstances other teachers are getting higher pay scale and the petitioner has been discriminated in the matter of grant of pay scale, the respondent-Director is hereby directed to dispose of the representation, if not already disposed of, by a reasoned and speaking order and in case it is found that the petitioner is entitled to pay scale of Rs. 9300-34800/-, the Director, Secondary Education will see that admissible pay is extended to this petitioner. In the event the Director finds that the petitioner is not entitled to the same pay scale, he shall pass reasoned and speaking order rejecting the claim of the petitioner within a period of sixty days from the date of receipt/production of a copy of this order.

With the aforesaid, the writ petition stands disposed of.
