The petitioners are apprehending their arrest in connection with Falka (Pothia) P.S.Case no.357 of 2018 , registered for offences punishable under Sections 341, 323, 325, 307, 354, 379, 504, 506/34 of the Indian Penal Code. Allegation against the petitioners and other accused persons is of assaulting the informant and others and also snatching chain of Rs.30,000/-.

Submission of the learned counsel for the petitioners is that there is case and counter case and the petitioner no.1 has also received grievous injury in the occurrence.

Patna High Court CR. MISC. No.6691 of 2019(4) dt.07-05-2019 2/2 Heard learned A.P.P. and the learned counsel for the O.P.No.2. They have opposed the prayer for bail stating that some of the injuries of the informant and others have been kept reserved.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-V, Katihar in connection with Falka (Pothia) P.S.Case no.357 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
