====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 05-04-2019 Heard Sri Rajesh Kumar, learned counsel for the petitioners and Sri Ram Anurag Singh, learned Addl. Public Prosecutor.

Two petitioners, who are named as accused in the F.I.R. in Parbatta (Maraiya) P.S. Case No. 302 of 2018 registered for the offence under Sections 147, 148, 149, 341, 307 and 302 of the Indian Penal Code, have prayed for grant of bail, in the event of their arrest or surrender. It was submitted by learned counsel for the petitioners that of course, in the F.I.R. accusation was made that informant was also assaulted, but during investigation, no injury was found on the person of the informant. He further submits that

Patna High Court CR. MISC. No.7776 of 2019(3) dt.05-04-2019 2/2 against number of accused persons during investigation, accusation was not found true.

Be that as it may, on examination of the F.I.R., it is evident that informant has specifically stated that while he was coming with his father on motorcycle, he was assaulted and anyhow, he fled away, however his father was intercepted and assaulted by all the accused persons, who were named in the F.I.R. including the petitioners. In such view of the matter, I am of the opinion that it is not a case for grant of anticipatory bail. The anticipatory bail petition stands dismissed. (Rakesh Kumar, J.) nawalkrs/- U T
