The petitioner seeks regular bail in connection with Pawna P.S. Case No. 53 of 2018 registered for the offence punishable under Section 353 of the Indian Penal Code and Sections 25(1-b)A, 26, 29, 30 and 35 of the Arms Act. The allegation is regarding the Police having received secret information that the co-accused person namely Vinit Singh was indulging in illicit business of arms whereupon the Police is said to have reached the house of the petitioner / the said co-accused Vinit Singh and recovered one rifle and some cartridges from the said house. Subsequently, the accused persons are said to have been apprehended by the Police.

No.2852 of 2019(2) dt.22-01-2019 2/2 The learned counsel for the petitioner submits that the fact is that no recovery has been made from the conscious possession of the petitioner herein who is said to be the father of the co-accused namely Vinit Singh. It is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 07.09.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Bhojpur at Ara in connection with Pawna P.S. Case No. 53 of 2018.
