JUSTICE SHIVAJI PANDEY ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and learned counsel for the State through Virtual Court proceeding. In the present case, the petitioner is seeking bail in connection with Sessions Trial No. 188 of 2019 arising out of Biribazar P.S. Case No. 38 of 2019, registered for the offence punishable under Sections 302/34 of the Indian Penal Code. There is specific allegation made against the petitioner to have strangulated and killed the toddler. Counsel for the petitioner submits that there is no eye witness to the occurrence and he has falsely been implicated in the present case inasmuch as he is in judicial custody since 01.04.2019.

Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner.

Patna High Court CR. MISC. No.3827 of 2020(4) dt.05-06-2020 2/2 Accordingly, the prayer for bail is rejected for the present.

However, this Court directs the court below to conclude the trial within nine months after restoration of normal court proceeding.
