The petitioner seeks quashing of the First Information Report of Pachrukhi P.S.Case No.57 of 2007 registered for the offence punishable under section 304-B of the Indian Penal Code.
The allegations made in the First Information Report do constitute a cognizable offence.
In that view of the matter, the First Information Report cannot be quashed. Moreover, during the pendency of this application, the police have already submitted charge sheet in the case and the Magistrate concerned after taking cognizance of the
Patna High Court Cr. WJC No.600 of 2014 (2) dt.09-02-2015 2/2 offence has already committed the case to the court of Sessions and charges have been framed.
In that view of the matter, the application, being devoid of any merit, is dismissed.
