The petitioner seeks bail in anticipation of his arrest in connection with Gogri P.S. Case No. 236 of 2020 instituted for the offences under Sections 147, 148, 149, 341, 323, 504, 506, 307, 308, 467, 468, 420, 385, 387 and 120B of the Indian Penal Code and Section 27 of the Arms Act.
Approximately 500 to 600 persons including the petitioner who have been named along with 29 other persons are alleged to have made attempts at usurping a plot of land measuring 18 acres. There is no specific
Patna High Court CR. MISC. No.12274 of 2021(2) dt.23-12-2021 2/2 accusation against the petitioner. The Court has also taken note of the fact that nobody has injured in the occurrence. Some of the accused persons of this case have been granted anticipatory bail by this Court vide order dated 21.12.2021 passed in Cr. Misc. No. 11494 of 2021. Regard being had to the general nature of accusation where several persons have been made accused and taking into account the gender of the petitioner, she is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Gogri P.S. Case No. 236 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
