2. The petitioner seeks bail in connection with G.R.P./Kiul P.S. case No. 269 of 2023 instituted for the offences under Section 414 of the Indian Penal Code.

3. It is alleged that on the basis of suspicion, police caught the petitioner and on search, two mobile phones, one blade, a small screw driver and a purse containing Rs. 2413/- were recovered.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case merely on the basis of suspicion. The recovered articles are not the stolen articles, and hence, no case under Section 414 of the

Patna High Court CR. MISC. No.6611 of 2024(2) dt.16-02-2024 2/2 IPC is made out against him. Learned counsel further submitted that the recovered mobile phones belongs to the petitioner as per Paragraph-42 and 43 of the Case Diary. It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.10.2023 and has two criminal antecedents but he is on bail in one case.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with G.R.P./Kiul P.S. case No. 269 of 2023.
