JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under sections 394 of the Indian Penal Code.

The petitioner is not named in the F.I.R. One coaccused Rajan Choudhary was arrested who confessed his guilt and took the name of the petitioner. One co-accused Ajay Patel who was also named by Rajan Choudhary has already been granted bail by this Court by order dated 15.03.2016 vide Criminal Misc. No. 11415 of 2016. So far as the petitioner is concerned, he has not been put on T.I. parade and except the confessional

Patna High Court Cr.Misc. No.16305 of 2016 (2) dt.22-04-2016 statement and the fact that he has criminal antecedents, there appears to be nothing against him. Moreover, charge-sheet has already been submitted in the case.

Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri B. K. Ray, Additional Chief Judicial Magistrate II, Bettiah in connection with Yogapatti P.S. Case No. 275 of 2015.
