Mr.Dr. Indiwar Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 The petitioner apprehends his arrest in connection with Complaint Case No. 1653 of 2015 registered under Sections 406 of the Indian penal Code.
Petitioner is uncle of the informant. It is alleged that after death of father of the informant, petitioner withdrew the insurance amount.
Submission of learned counsel for the petitioner is that for the same occurrence, niece of the petitioner has also filed a case against the petitioner and in that case he has been granted bail and in the present case, the police after investigation has submitted final form but on protest cognizance has been taken. Heard learned APP also.

No.11869 of 2019(2) dt.27-02-2019 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea in connection with Complaint Case No. 1653 of 2015; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
