Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Kuchaikote P.S. Case No. 375/2021 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

Petitioner is the owner of the commercial vehicle running between Delhi and Muzaffarpur and some liquor has been recovered from his vehicle for which the petitioner cannot be held liable.

Patna High Court CR. MISC. No.4680 of 2022(2) dt.07-03-2022 2/2 Considering the facts and circumstances, the present anticipatory bail application is allowed.

Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge cum Special Judge, Excise, Gopalganj, in connection with Kuchaikote P.S. Case No. 375/2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
