In the instant petition, petitioner has prayed to direct the respondent 1st set to protect the petitioner for making his house over the land situated at Mauza Doriyaon, Thana No.97, Khata No.179, Khesra No.878, admeasuring 06 decimals, is a Purcha land of petitioner which was settled vide a Settlement Case No.11 of 2005-06 thereafter issued Purcha in the name of one Gupteshwar Chaudhary S/o Late Jagdeo Chaudhary of Doriyaon village (the late husband of the petitioner) on 08.11.2007 but the boundary raiyats are creating

Patna High Court CWJC No.5571 of 2019(4) dt.27-03-2025 2/2 every trouble in threat to leave from here for other place to the petitioner and also to direct the respondent 2nd set to not interfere on the land in question and to act according to measurement and thereafter taken a decision by submitting consented and undersigned the parties in Camp Court vide Case No.GKK-23/08 which was disposed of on 13.10.2008.

3. Learned counsel for the petitioner submits that this case may be disposed of with liberty to the petitioner to take appropriate steps for measurement of the land in question by the concerned authority.

4. Learned counsel for the State has no objection to this prayer of the petitioner.

5. In view of the submissions of learned counsel for the parties, the present writ petition stands disposed of with liberty to the petitioner, as prayed for.
