====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 22-02-2019 Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners are seeking anticipatory bail in connection with Amnour P.S. Case No. 167 of 2018, registered for the offence punishable under Sections 304 (B)/34 of the Indian Penal Code.
The allegation against the accused persons including the petitioners is to have killed the daughter of the informant due to non- fulfillment of demand of dowry.
It appears that the marriage was solemnized on 25.06.2018 and the daughter of the informant had been killed on 17.08.2018. Only within two months, the lady has been found to
Patna High Court Cr.Misc. No.5631 of 2019(3) dt.22-02-2019 2/2 be dead. The petitioners are mother-in-law and father-in-law of the deceased.
Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within four weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
