JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-04-2019 This is an application for grant of anticipatory bail in connection with Rani Talab P.S. Case No. 300 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code.
This case is based on the complaint petition upon which the F.I.R. was registered later on and allegation as per complaint petition is that the deceased, who was wife of Chandan Kumar has been subjected to torture by the petitioner and other accused persons and the complainant came to know that the deceased has committed suicide by hanging and on that information, he went there and found the dead-body of the deceased.
Submission of learned counsel for the petitioner is that he is the Bhaisur of the deceased and no specific allegation
Patna High Court CR. MISC. No.4846 of 2019(4) dt.05-04-2019 2/2 has been attributed against him and the other co-accused person i.e. mother-in-law of the deceased has already been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 19.02.2019 passed in Cr. Misc. No.9540 of 2019. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st, Danapur, Patna, in connection with Rani Talab P.S. Case No. 300 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
