JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and learned A.P.P. appearing for the State.

The petitioner is in custody in a case registered under Sections 326, 307/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case, in brief, is that on 14.02.2013 the informant heard sound of firing at the door of Kamleshwar Prasad Yadav, and the informant and other villagers started fleeing away. Sometimes thereafter the villagers and the informant assembled at the house of Kamleshwar Prasad Yadav and found blood was oozing out from the body of Kamleshwar Prasad Yadav. In the meantime, two unknown persons came there on motorcycle and again started firing on Kamleshwar Prasad Yadav, his

Both the injured were then taken to S.K.M.C.H., Muzaffarpur for treatment. It is submitted on behalf of the petitioner that the petitioner is in custody since 29.05.2014 and charge sheet has been submitted in this case. It is further submitted that the petitioner is not named in the FIR.

On behalf of the State it has been submitted that the petitioner's name has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No. 29 of 2013.
