JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report in respect of an occurrence of murder and assault and the said occurrence took place in the year 2004 but the petitioner could be remanded in this case on 04.03.2015, i.e., near about after 11 years of the alleged occurrence. Moreover, it is informed that other co-accused faced trial and have been convicted by the trial court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and, hence, his prayer for bail in connection with Agiaon Bazar P.S.Case No. 01 of 2004, pending in the court

Patna High Court Cr.Misc. No.16088 of 2016 (2) dt.21-04-2016 2/2 of learned Judicial Magistrate, 1st class, Bhojpur at Ara stands rejected.

However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six months after receipt/production of copy of this order, failing which petitioner may renew his prayer for bail before the trial court itself.
