The petitioner seeks bail in connection with Paliganj P.S. Case No. 560 of 2023 instituted for the offence under Sections 420, 467, 468, 308 & 34 of the Indian Penal Code and Section 34(2) of the National Medical Commission Act.

Prosecution case in short is that on a raid conducted by the police, it was found that surgery was being done in a private hospital and, on inquiry, the accused persons failed to produce any paper for running the hospital and also conducting the operation.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.6894 of 2024(2) dt.17-02-2024 2/3 that the petitioner is in custody since 18-10-2023. Petitioner is stated to be man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that the petitioner has got no concern with the alleged nursing home. The name of the petitioner has transpired as being owner of the building in which the nursing home was running. The petitioner submits that the said building was given by him on rent. There is no direct allegation against the petitioner. Other co-accused has also been granted bail by Co-ordinate Bench of this Court vide order dated 12-02-2024, passed in Cr. Misc. No. 4781 of 2024. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, clean antecedent of the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Paliganj
