JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 07-10-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceeding. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in connection with Bettiah Town (Kalibag O.P.) P.S. Case No. 582/20 (G.R. No. 4414/20) registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.
The prosecution case as traced out from the fardbeyan of the informant is that his son Naveen Kumar was playing Kabaddi

No.15202 of 2021(3) dt.07-10-2021 2/3 and during that quarrel took place between his son and co-accused Chandan Mahto due to which accused persons brutally assaulted his son and extended threat to kill him. Again on 10.09.2020 at about 5 in the evening petitioner came at informant's house and took away his son did not return. On 15.09.2020 informant received informant that dead body of his son was lying in Basant Tola. It is alleged that petitioner and co-accused persons have committed murder of his son.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and has not committed any offence as alleged in the FIR. He submits that, as a matter of fact, deceased was a thief and he used to commit theft of electric wire and on the date of occurrence he had gone to commit theft of LED motor light from the pole but accidentally he was effected by wire and died due to electric shot. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has no criminal antecedent as has been mentioned in para 3 of this bail application and has been languishing in custody since 07.09.2020.
Learned APP for the State opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the
