Petitioner apprehends his arrest in connection with Chakmehsi P.S. Case No. 94 of 2022 registered for the offences punishable under Sections 341, 323, 324, 379, 506/34 of the Indian Penal Code.

As per the prosecution case, all the FIR named accused persons including the petitioner assaulted the informant by iron rod and brick due to which the informant sustained injury on his head and his left hand got fractured. Learned counsel for the petitioner submitted that petitioner has falsely been implicated in this case. It is submitted that occurrence took place on 4.05.2022 and the FIR has been

Patna High Court CR. MISC. No.6355 of 2023(2) dt.08-05-2023 2/2 lodged on 23.05.2022 after delay of 18 days without giving any reasonable cause. Occurrence took place due to previous enmity between the parties. . It is further submitted that petitioner has clean antecedent as stated in para-3 of this application. Learned APP for the State and learned counsel for the informant opposes the bail prayer.

Considering the delay of filing of the FIR and submissions of the parties, let the above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Samastipur in Chakmehsi P.S. Case No. 94 of 2022 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) N.K/- U T
