The petitioner seeks regular bail in a case registered under Section 307 and other sections of the Indian Penal Code. The informant Hareram Kumar alleged that on 18.10.2014, the petitioner Vinoy Kumar and Baleshwar Singh chased his brother and Vinoy Kumar fired which hit on the chest of his brother Adhir Singh. It is submitted that the occurrence took place on 18.10.2014 but the brother of the informant lodged the case on 19.10.2014. Adhir Singh, the injured, made his statement in P.M.C.H. and disclosed that Vinoy Kumar (the petitioner), Bambam Singh and Baleshwar Singh surrounded him and Bambam Singh fired which hit in his chest. The injured has altogether made a different story about the occurrence. The injured also made his statement in Para 41 of the case diary and he has
Patna High Court Cr.Misc. No.10650 of 2015 (5) dt.21-05-2015 2/2 reiterated the same fact that Bambam Singh fired which hit on his chest. Bambam Singh has already been enlarged on bail by the learned Additional Sessions Judge.
It appears that of course the informant has alleged that it was the petitioner who fired but the injured himself made altogether different statements and stated that Vinoy Kumar caught him and Bambam Singh fired. Bambam Singh has already been enlarged on bail.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Barh, Patna in Barh P.S. Case No. 422 of 2014.
