JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Jhanjharpur P.S. Case No. 144 of 2019 registered for the offences punishable under Sections 341, 323, 308, 354, 379, 504 and 506/34 of the Indian Penal Code. As per FIR, petitioner is said to have repeatedly assaulted the aunt of the informant by rod, causing injuries to her and there is allegation of assault to the informant by other accused persons.

Submission of learned counsel for the petitioner is that there is inordinate delay in lodging FIR and prior to the present case an FIR was registered by the petitioner's side and there is case and counter case with respect to the same occurrence and injuries are simple in nature.

In view of above facts and circumstances, let petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Jhanjharpur, Madhubani, in connection with Jhanjharpur P.S. Case No. 144 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
