The petitioner is languishing in custody since 03.09.2012 in a case registered for the offences punishable under Sections 353, 307 of the Indian Penal Code and 25(1-B)a/26/27/35 of the Arms Act.

Prosecution case is that the informant being the Police Inspector went to arrest the petitioner in connection with Dhanarua P.S. Case No. 266 of 2012 then this petitioner resorted to fire. Ultimately the recovery of one country made pistol and three cartridges were made from the petitioner. It is submitted by learned counsel for the petitioner that the recovery has not been made from the possession

Patna High Court Cr.Misc. No.15626 of 2015 (02) dt.21-05-2015 2/2 of the petitioner and accusation of resorting to fire on the police personnel is developed story. No injury was caused to anyone. The petitioner is accused in one other case apart from the present case. Statement to that effect has been made in para 3 of the petition. Considering the above submissions, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Patna in connection with Sessions Trial No. 482 of 2013 arising out of Dhanarua P.S.
