JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 399, 402, 412 and 120(B) of the Indian Penal Code. Petitioner was neither arrested nor anything was recovered from his conscious possession and it would appear from the first information report itself that the name of the petitioner came in confessional statement of co-accused persons, who were arrested on the spot. Moreover, having more or less similar allegation, one co-accused Hemant Kumar has been granted privilege of bail.
Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten
Patna High Court Cr.Misc. No.16999 of 2016 (2) dt.28-04-2016 2/2 thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Daudnagar, Aurangabad in connection with Daudnagar P.S. Case No.225 of 2015.
