JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Petitioners are languishing in custody since 22.03.2015 in a case registered for the offences punishable under Sections 147, 148, 323, 353, 435, 338, 337, 332, 333, 436, 307, 427, 448, 341, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that in a protest for the murder of a school teacher the mob of 400-500 blocked the G.T. road. The mob wanted to take the accused of murder case in their custody. The accused persons resorted to fire and also pelted stones causing injuries to the police personnel and others whereas the Fire Brigade vehicle was also damaged by the mob.

Patna High Court Cr.Misc. No.25216 of 2015 (2) dt.24-07-2015 2/2 It is submitted by learned counsel for the petitioners that accusation is omnibus and general against the mob. Moreover the investigation has already concluded. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S. Case No. 88 of 2015.
