JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-04-2019 The petitioner apprehends his arrest in connection with Bakhtiarpur P.S.Case No. 281 of 2018 registered under Sections 147,148,149 and 302 of the Indian penal Code. Allegation against the petitioner and other accused persons is of assaulting by lathi, danda, rod and brick-bats to the deceased and specific allegation against one Dinesh Singh is of assaulting by Garasa on the head and ear of the deceased and due to that he succumbed to injuries.

Submission of learned counsel for the petitioner is that 14 named and unnamed persons are made accused in this case and no specific allegation has been attributed against the petitioner whereas specific allegation of assault is against one Dinesh Singh and one co-accused Ganesh Singh having similar allegation has been granted anticipatory bail this court vide order dated 04.04.2019 passed in Cr.Misc. No. 7113 of 2019. It

Patna High Court CR. MISC. No.4358 of 2019(4) dt.05-04-2019 2/2 has also been submitted that petitioner is accused in one more case but he has been acquitted which he has stated on oath. Heard learned APP and learned counsel appearing on behalf of the informant also who have opposed the prayer for anticipatory bail on the ground the petitioner has criminal antecedent also and there is allegation against all the accused persons of assault.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Barh, Patna in connection with Bakhtiarpur P.S. Case No. 281 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
