The petitioner is in custody in a case registered under Sections 366/120B/34 of the Indian Penal Code, Sections 3(i)(xi) of the S.C./S.T. Act and Section 66 of the Information Technology Act.
The prosecution case, in brief, is that on 31.12.2014 the informant gave a written report before the S.I. of Nirmali P.S. alleging therein that her daughter Narmata Anand is traceless since the morning. On being traced, the villagers told that she was seen on 31.12.2014 at Bhutha Chouk. The informant has received calls from mobile No. 9973161120 and she has apprehension that his daughter has been kidnapped by the accused persons. On the information
Patna High Court Cr.Misc. No.25000 of 2015 (2) dt.21-07-2015 furnished by her Nirmali P.S. Case No. 01 of 2015. It has been submitted on behalf of the petitioner that the petitioner is in custody since 03.01.2015 and the charge sheet has been submitted in the case. It is further submitted that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner may be released after completion of nine months in custody.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R. and there is direct allegation against the petitioner for committing the offence. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail after completion of nine months from 03.01.2015 on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Birpur in connection with Nirmali P.S.
