The petitioner seeks bail in Excise Compalint Case no.146 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. The allegation against the petitioner is about recovery of 20 liters of country made liquor from a motorcycle. Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case,having no criminal antecedent, and he is in custody since 16.12.2019. Further submission is that nothing has been recovered from the possession of the petitioner nor the alleged motorcycle belongs to the petitioner.

Sessions Judge-cum- Special Judge, Excise Act, Banka in connection with Excise Complaint Case No.146 of 2019 with the condition that the petitioner shall co-operate with the trial/investigation, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
