The petitioner is in custody in a case registered under Section 396 of the Indian Penal Code and Section 17 of C.L.A.Act.

The prosecution case in, brief, is that Naxlies taking advantage of rally has attacked Rail Police Station. One accused dealt a blow on the head of informant with intention to kill. Informant's head was fractured. The informant was brought hospital for treatment. After returning from hospital, the informant learnt that naxalies had taken away all rifles, carbine and bullets from rail police Station and killed constable and Saif Jawan. It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.26018 of 2015 (2) dt.24-07-2015 2/2 petitioner is in custody since 2.9.2014 and charge sheet has been submitted in this case. The petitioner is not named in the FIR. It is further submitted that other co-accused has been granted bail by this Court, vide Cr. Misc. No.19755 of 2011 on 23.09.2011. On behalf of the State, the name of the petitioner has come in course of investigation.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and sessions judge-II, Lakhisarai, in Jhajha Rail P.S.Case No. 15 of 2008.
