JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Brahmpur Krishna Braham P.S. Case No. 379 of 2019 for offences under Sections 420, 465, 468, 471, 193 and 120B of the Indian Penal Code.

Relying upon Section 173(2) of the Cr.P.C., learned counsel for the petitioner submits that contrary to the provision of law, the accused has filed FIR which is not maintainable. The allegation against the petitioner is that he lodged a false case against the informant of this case along with others. Learned counsel for the petitioner submitted that in that case the police submitted charge sheet against the informant of this case and the Court has taken cognizance of the offence.

Let petitioner, above-named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Brahmpur Krishna Braham P.S. Case No. 379 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
