JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 25.12.2015 in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

It appears from perusal of the impugned order that at para-24 of the case diary, one witness stated about the involvement of the petitioner in the alleged crime but submission on behalf of the petitioner is that the name of petitioner came in the statement of spy of police and except the aforesaid material as well as some criminal antecedent, there is nothing against the petitioner. Moreover, petitioner has not been put on Test Identification Parade as yet.

No.18097 of 2016 (2) dt.02-05-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, (West) Muzaffarpur in connection with Kanti P.S. Case No. 485 of 2015.
