The petitioner, being the husband of the complainant, is languishing in custody since 22.08.2018 in a case registered for the offences punishable under Section 498A of the IPC and Section 4 of the Dowry Prohibition Act.

The prosecution case, as per the complaint petition, is to the effect that the complainant was married with the petitioner on 21.06.2003, but subsequent to the marriage, further dowry demand of Rs. 50,000/- and a motorcycle was made and due to non-fulfillment of the same, torture was inflicted by the petitioner upon the complainant.

Patna High Court Cr.Misc. No.2481 of 2019(2) dt.22-01-2019 2/2 It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the complainant, but it is the complainant, who deserted the petitioner.

Learned APP submits that after finding prima facie case, cognizance has been taken against the petitioner. Considering the nature of accusation and the period under custody, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned SDJM, Patna in connection with Complaint Case No. 1478C of 2011.
