Mr.Rajendra Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-07-2022 Heard learned counsel for the petitioners and the State.

The petitioners apprehend arrest in a case registered for the offence punishable under sections 354B, 379 and other ancillary sections of the Indian Penal Code.

Prosecution case is that the petitioners and other accused persons assaulted the wife of the informant and tried to outrage her modesty and snatched her neckless.

Patna High Court CR. MISC. No.5604 of 2022(2) dt.28-07-2022 2/2 Learned counsel for the petitioners submits that admittedly due to land dispute simple marpit took place between the parties. There is case and counter case, as petitioners' side instituted case bearing Konch Police Station Case No. 155 of 2021 against the informant and others. No specific overt act has been alleged against the petitioners. Petitioners have got no criminal antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let all the petitioners mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Gaya in Konch Police Station Case No. 154 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
