In the background of institution of case for disappearance of her daughter from her Sasural, it has been alleged that on the alleged date and time of occurrence while informant, her husband, her son were in a way to their house, Indradeo Prasad, Binod Prasad, Mahadeo Prasad, Naresh Prasad, Umesh Prasad along with two unknown persons pounced upon them, out of whom Binod Prasad and Mahadeo Prasad caught hold informant as well as her son while remaining dragged her husband to a litchi orchard where on an order of Umesh Prasad, Naresh Prasad shot at causing instantaneous death. Though petitioner is not named in the FIR and his complicity has been found subsequently with an attestation of inculpatory extra judicial confession however could not be accepted as an author of the fatal injury in the background of the fact that there happens to be specific disclosure in which written report regarding Naresh to be the assailant.
Patna High Court Cr.Misc. No.18082 of 2015 (2) dt.22-05-2015 Accordingly, Sanjay Paswan is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Sub-divisional Judicial Magistrate, Sikrahana at Motihari, East Champaran in connection with Madhuban P.S.
