JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 The petitioner seeks regular bail in connection with Uchkagaon P.S. Case No. 235 of 2018, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Allegation is of recovery of 360.720 litres of liquor from the vehicle and driver of the vehicle disclosed the names of petitioner and others. Apart from that it appears that petitioner is accused in six other cases of similar nature. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case only because he is carrying criminal antecedents of similar nature and except that there is nothing against the petitioner and he has been in custody since 20.11.2019.

Heard learned A.P.P. also.

Patna High Court CR. MISC. No.6495 of 2020(2) dt.05-02-2020 2/2 Considering the facts and circumstances of the case as well as the fact that petitioner is accused in six other cases of similar nature, I am not inclined to enlarge the petitioner on bail at this stage. However, once charge is framed, the petitioner will be at liberty to renew his prayer for bail. This application is accordingly dismissed.
