The petitioner is in custody in a case registered under Sections 324, 326 and 307/34 of the Indian Penal Code. The prosecution case in, brief, is that while the informant along with his cousin brother was going to his house, in the meantime accused persons came there and this petitioner shot at the informant which hit at the elbow of his right hand. When the informant tried to flee away then other co accused also fired which did not hit him. It is further alleged that the informant came at the home in injured condition and thereafter he was brought for treatment.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.26004 of 2015 (2) dt.24-07-2015 2/2 petitioner is in custody since 4.2.2015 and charge sheet has been submitted in this case. Further, it has been submitted that though the allegation is of firing against the petitioner but he has been falsely implicated in this case due to previous enmity. Further, it has been submitted that the petitioner may be released after completion of nine months in custody from 4.2.2015. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail, after completion of nine months in custody from 4.2.2015, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Khagaria in Naugachhiya Rail P.S.Case No. 13/2014.
