JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, petitioner is named in the first information report with accusation that he snatched Rs.36000/- from the pocket of the informant , who happens to be peon in the Bank, and also demanded extortion money of Rs.5 lacs but submission on behalf of the petitioner is that the present case has been lodged by the informant at the behest of Bank Manager and, as a matter of fact, the petitioner had gone to the concerned Bank for some work but the concerned Bank Manager demanded bribe from the petitioner which was opposed by the petitioner and, after that, hot exchange of words took place between the petitioner and the concerned Bank Manager and, thereafter, the concerned Bank

Patna High Court Cr.Misc. No.16251 of 2016 (2) dt.22-04-2016 2/2 Manager got managed the informant, who got instituted this false case against the petitioner. It is further submitted that no doubt, petitioner carries criminal antecedent of four cases but in the present case, he was caught from his house and nothing was recovered form conscious possession of the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Bikramganj, Rohtas in connection with Dinara P.S.case No. 42 of 2016.
