JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2020 Petitioner seeks regular bail in connection with Muffasil P.S. Case No. 222 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Allegation is that, there is a recovery of 10 liters of country-made liquor from the petitioner. It further appears that he is an accused in one more case.

Submission of the learned counsel for the petitioner is that, he is an accused on one case but he is on bail in that case. So far as, this case is concerned, nothing has been recovered from the conscious possession of the petitioner and nothing has been recovered from his house. Petitioner's name was disclosed by co-accused and he is in custody for more than 1 month. He is ready to cooperate in the investigation.

Having heard both sides, in view of the submissions, made above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional District and Sessions Judge-IIcum-Special Judge, Nawada, in connection with Muffasil P. S. Case No. 222 of 2019, subject to the condition that he has to appear before the I.O. as and when require otherwise his bail bond shall be canceled.
