1. Heard learned counsel for the petitioners and learned APP for the State along with learned counsel for the O.P. No. 2.
2. The learned counsel for the O.P. No. 2 submits that in the present quashing application, the order of cognizance is under challenge, when even the discharge application of the petitioners herein has been rejected by the learned Trial court. It
Patna High Court CR. MISC. No.5418 of 2019(3) dt.29-01-2024 2/2 is further submitted that the petitioners have moved this Court seeking quashing of the order of discharge also, which is pending adjudication in Criminal Miscellaneous No. 54290 of 2023, at this stage, the learned counsel for the petitioners seeks permission to withdraw the present quashing application with liberty to pursue Criminal Miscellaneous No. 54290 of 2023.
