The petitioner is in custody since 17.09.2018 in connection with Rafiganj P.S. Case No. 174 of 2018 for the offence registered under Sections 366(A), 34 of the Indian Penal Code.

It appears that the petitioner is named accused in the present case. The victim girl was recovered whose statement was recorded under Section 164 Cr.P.C. In the said statement, the victim girl clearly stated that she had gone with the petitioner and that they were knowing each other since long. The age of victim girl has been stated to be between 17-18 years. In her statement under Section 164 Cr.P.C. the victim girl also stated that Javed Ahmad has no role to play.

No.3067 of 2019(3) dt.28-02-2019 2/2 Considering the aforesaid facts and circumstances of the case and that the petitioner has already been custody since 17.09.2018 having clean antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Rafiganj P.S. Case No. 174 of 2018.
