2. The petitioner is in custody since 24.12.2017 in connection with Kaluahi P.S. Case No. 155 of 2017 for the offences alleged under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code and has renewed his prayer for bail having twice been rejected earlier by orders dated 03.05.2018 and 24.08.2018 passed in Cr. Misc. No. 25176 of 2018 and Cr. Misc. No. 42390 of 2018, respectively.

3. Learned counsel for the petitioner submits that till date no progress has been made in the trial.

4. Be that as it may, having regard to the entirety of the facts and circumstances of the case and having regard to the period of custody of the petitioner since 24.12.2017, let him be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Madhubani, in connection with Kaluahi P.S. Case No. 155 of 2017, on the following conditions:- (i) That one of the bailors shall be a close relative of the

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.

(iii) That the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned. BT/- (Vikash Jain, J) U T
