2. Counsel for the petitioner submits that the present writ petition has been filed relating to dispute on petitioner's land bearing Plot No.1762, Khata No.41 having an area of 3
Patna High Court CWJC No.10817 of 2015(3) dt.18-08-2023 2/2 Kathas, 11 Dhur situtated at Mauza Bhalpatti, Darbhanga on which disturbances are created by the private respondent no.7. Counsel submits that the genesis of this land is Bhudan Yagna Act, 1954.
3. Counsel for the Bhudan Yagna Committee submits that there is a specific provision under Section 14 A of the Bhudan Yagna Act, 1954, under which the petitioner may avail remedy by filing an application before Revenue Authority, who shall decided upon hearing both the parties.
4. In this matter, this writ disposed off with direction to the petitioner to avail his remedy under Section 14 A of the Bhudan Yagna Act, 1954 and then Revenue Authority/ Circle Officer, Darbhanga shall pass a reasoned order upon hearing the parties as well taking stand of Bhudan Yagna Committee of the district Darbhanga. Petitioner is directed to file his application within 4 weeks from the order to Circle Officer, Darbhanga who shall pass reasoned order within 6 weeks upon appearance of the parties.
