The petitioner seeks bail in Madanpur P.S. Case No. 243 of 2010, instituted for the offence under Section(s) 147, 148, 149, 447, 323, 504, 342, 435, 427 of the Indian Penal Code, Section 27 of Arms Act and Section 17 of CLA Act. It is alleged in the written report that the informant was sleeping on a Chauki in the premises of Mobile Tower, 4050 miscreants armed with weapons came and assaulted him. They took over key from the informant and tied his hands. It is further alleged that they set the Tower, Generator, tent, tools room etc. on fire. They were raising slogan of Pro MCC. Patna High Court Cr.Misc. No.6040 of 2019(2) dt.04-02-2019 2/2 Information Report is against unknown. The name of petitioner has come during investigation only on the basis of disclosure made by the spy and confessional statement of co-accused Lala Yadav. Counsel for the petitioner further submits that coaccused Kail Prajapati @ Satyanarayan Pandit @ Hargovind Pandit @ Akashjee has already been granted bail by coordinate Bench of this Court vide order dated 3.5.2016 passed in Cr. Misc. 18634 of 2016.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Aurangabad (Bihar), in connection with Madanpur P.S. Case No. 243 of 2010, subject to the condition that both the bailors will be the close relatives of the petitioner.
