JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-09-2022 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of an appropriate writ in the nature of mandamus, commanding and directing the respondent authorities to construct the Pulia (Culvert) of 1000 M.M. in village-Dubey Deharia Path from N.H. 30 under Mukhyamantri Gram Sadak Yojana which was approved and sanctioned by the Government of Bihar.

Patna High Court CWJC No.24738 of 2018(2) dt.13-09-2022 2/3 (ii) For issuance of an appropriate writ in the nature of mandamus, commanding and directing the respondent authorities to construct and complete Pulia (Culvert) as per sanctioned and planned by respondent authorities from N.H. 30 to village-Dubey Deharia Path under Mukhya Mantri Gram Sadak Yojana which was sanctioned and approved in the year 2012-13 at the estimated cost of Rs. 59,36,000/- and expensed on the said road only Rs. 50,16,700/- after not built two culvert by the respondent authorities as per sanctioned and estimated plan."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Kaimur at Bhabhua for redressal of his aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case, appropriate petition is filed by the petitioner before the District Magistrate, Kaimur at Bhabhua within a

Patna High Court CWJC No.24738 of 2018(2) dt.13-09-2022 3/3 period of six weeks from today, appropriate decision shall be taken by the District Magistrate, Kaimur at Bhabhua within a period of twelve weeks, thereafter by taking into account the prevailing situation as also in accordance with law. The writ petition stands disposed of on the aforesaid terms.
