JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 The petitioner seeks regular bail in connection with Nalanda P.S. Case No. 165 of 2019, registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case is that two vehicles were intercepted and from one vehicle, there is recovery of 24 litres of beer and from another vehicle, there is recovery of 120 litres of beer and petitioner and other accused persons were arrested there. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and he is neither driver of the vehicles nor the owner of the vehicles and he was only a passenger. Further he has no criminal antecedent and has been in judicial custody since 11.11.2019.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge -cum-Special Judge, Excise Act, Nalanda in connection with Nalanda P.S. Case No. 165 of 2019.
