2. The petitioner seeks bail in connection with Chakand P.S. Case No. 315 of 2024 dated 13.11.2024, instituted for the offence punishable under Sections 309(4) of the Bhartiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that the informant went to village- Mahmudabad for collection of money on 12.11.2024. When the informant was returning after collection of money i.e. Rs. 2,21,270/- from the said village then in the midway, two unknown persons hit him from the back as a result of which he fell down then both the accused persons assaulted

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that F.I.R. has been lodged against unknown persons. It is next submitted that the petitioner has been made accused in this case only on the basis of confessional statement of co-accused Mundrika kumar. It is further submitted that one Apache motorcycle has been recovered from the possession of the petitioner but there is no complaint regarding the said motorcycle. It is further submitted that no incriminating or looted articles has been recovered from the possession of the petitioner. It is also submitted that no T.I.P. has been conducted till date. Lastly, it has been submitted that the petitioner is in custody since 15.11.2024 having no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Gaya in
